Dog Bite Law in New Jersey

Many people mistakenly believe that dog bite cases are limited to the so-called dangerous dog breeds such as Rottweilers, pit bulls and Doberman pinchers. While the nature of the dog and its past history can be relevant factors, they do not determine whether you have a case.

In New Jersey there is no "free first bite" as there is in some states. If a dog bites you, the owner is liable for your damages, including pain and suffering and medical expenses. This is called 'strict liability.' Dogs are always supposed to be on leashes except on fenced properties or in designated dog runs or parks. If a loose dog bites you, you are entitled to damages. If a dog being walked bites or jumps on you causing you injury, you are entitled to damages.

What You Need to Prove

The most important thing is to identify the dog. The name of the dog ("Killer" or "Spot") and the approximate size, shape and color are helpful facts to note. If the police were called there will usually be a report with the local Animal Control. Dogs that bite are required to be examined for rabies and the local town usually enforces this rule. Once the dog is identified, the owner needs to be determined. If the dog is registered, the owner's information will be listed. Sometimes it is not clear because the dog is living with someone other than the owner. Further investigation may be needed. Our experienced attorneys can help identify the dog and owner, identify any applicable insurance, and prosecute your claim for compensation.
