Negligence in the workplace and your injury in New Jersey

As someone who has suffered from a construction accident in the workplace, you may be wondering what kind of legal claims you can make against the negligent party. It's important to know that any claim you make can be affected by the workers' compensation laws. You will also be affected by the extent to which your employer is responsible for your injuries.

Here are some things you should receive, thanks to workers' compensation laws. First of all, your medical care should be covered as long as it's reasonable. Under workers' compensation benefits, you may have to use the company doctor for up to 30 days, but you do have a right to all reasonable necessary treatments. After 30 days, you may ask to have a different doctor.

Under the rights of workers' compensation, you should receive temporary disability payments if you have to take time away from work. Normally, the amount you'll receive is equal to two-thirds of your average weekly gross income, and it will be paid out every two weeks. If you instead suffer from permanent disability, you may be entitled to a monetary reward. That means that since you can't work, you may be entitled to a large payout to cover your needs now and in the future.

You may have to go through vocational rehabilitation, which is where you can be trained to get another kind of job. This is particularly true if you've lost a limb or simply can no longer perform your old job due to injury. During this time, you'll also receive a partial income, which helps you take care of yourself and needs while you go through the program.
