Fatal accident could have involved texting, according to courts

Pedestrians are often in danger when they're out walking near roads, especially when drivers aren't paying as much attention as they should be. A simple, low-speed accident can result in a pedestrian's serious injuries or death, even in cases where a vehicle is moving slowly in a parking lot or on a residential avenue. The weight of a vehicle combined with any speed can make impacts or crushing injuries deadly.

This was true in the case involving a 25-year-old woman who struck a 76-year-old man, leading to his death. The woman had been driving on Route 9 in New Jersey when she collided with the man who was on a daily walk near his home.

The woman was not intoxicated at the time of the accident, and it was shown that she wasn't speeding or driving recklessly. However, there is concern that the young woman may have been texting at the time of the accident. The court has indicted her for two counts for violating the law protecting public safety.

Her legal team has fought the allegations that she was texting at the time of the accident, and they claim there is proof that she was not. However, it would be possible to face charges for being distracted in any way, whether she was on the phone or putting on makeup at the time of the crash.

Locals have said there is no sidewalk in the area, which could have played a part in the accident. If texting is found to be the real cause of the accident, the woman faces up to 10 years in prison when she's convicted for the man's death.
