Morgan and Wal-Mart settle after fatal accident

If you remember the accident that involved comedian Tracy Morgan and James McNair, then you recall that it was a Wal-Mart truck that struck the back of the vehicle carrying the men and others. The truck driver was accused of several violations of trucking laws, and he faces various criminal charges in New Jersey state court. One of those charges is for the death of a man by auto, which could result in a prison sentence. So far, the driver of the Wal-Mart truck has pleaded not guilty.

The initial investigation into the crash showed that the Wal-Mart diver had been traveling 65 mph when he struck the limo van carrying Morgan and others along the New Jersey Turnpike. On that section of the turnpike, the speed limit had been lowered to 45 due to construction. The truck driver had allegedly slowed for traffic but had to swerve to avoid a crash. When he did that, he struck the back of the limo.

A filing that was placed with the federal court in Newark showed that a confidential settlement was reached between Morgan and the Arkansas-based Wal-Mart stores. Wal-Mart spokesmen have reported the settlement as amicable, but there is not be much news on what it was. The settlement should have covered Morgan's injuries and time away from work; he suffered a head injury, broken ribs and a broken leg. He is still recovering now, and he hasn't been able to return to work since the accident took place.

Others involved in the accident are also working with Wal-Mart to reach a settlement. Wal-Mart has said that the company is committed to doing what is right for these individuals.
