Third-party liability and what you can do after a collision

If you're a passenger in an Uber vehicle, do you know how to get compensated if your driver is involved in an accident? What about if you're driving or walking and are hit by an Uber driver? There are several possibilities, from seeking compensation from Uber itself to pursuing compensation from the driver.

It's a fact that Uber's insurance coverage varies widely depending on what the driver is doing. For instance, if a driver is simply driving around and hits someone, the driver is in what is known as "period 1," and won't offer any coverage for the driver. It doesn't offer collision or comprehensive damage, so if the driver doesn't have his or her own insurance, you, as a victim, could be looking at suing him or her directly.

On the other hand, if the driver has a passenger in the vehicle, then you will be in a better position to get coverage from Uber directly as well as the driver. During the times when a passenger is in the vehicle, Uber covers accidents. Uber uses a $1 million liability policy, which should protect the driver, you and any passenger in the case of an accident.

The driver, to be sure he or her has coverage at all times, should have personal collision/comprehensive insurance. Failing to do that means his or her claims may be denied, and those injured might have to sue him or her directly.

Every car accident is different, and what you need to be compensated may vary. Our website has more information on the steps you can take to make sure your voice gets heard.
