Premises liability claim filed against Lowe's after alleged fall

One certainty in an uncertain world is that accidents are going to happen. Some accidents are impossible to anticipate and thus totally unavoidable. However, some accidents can be prevented. In the state of New Jersey and across the country, property and business owners have a legal responsibility to keep their properties safe for all visitors. Taking even the most basic precautions such as maintaining property and removing hazards can go a long way in preventing accidents to patrons and visitors.

When hazards or negligent maintenance cause injury to those lawfully visiting a business or property, a premises liability claim can be filed. Recently, a lawsuit was filed against a Lowe's store in another state after a man visiting the store was allegedly injured. The man claims he fell due to unmarked hazards left on the floor. According to the lawsuit, the man slipped and fell on what he claimed to be sand left on the floor.

Allegedly, as the man fell, he struck his head on the floor and lost consciousness. The plaintiff accuses the Lowe's store of negligence as he claims the store owners knew of the alleged hazard but failed to warn customers of the dangers. The plaintiff seeks general and compensatory damages, as well as court costs and all other relief.

Thousands of people in New Jersey and across the United States are injured each year due to hazards or property neglect. A premises liability claim can be filed when unmarked hazards, careless maintenance or neglect cause injuries to visitors. A successful claim could result in a monetary award to cover lost wages and medical expenses.
