If you've witnessed or had the misfortune to be part of a pedestrian accident, you know how serious and immediate the danger is. This fatal pedestrian accident took place when a tractor-trailer struck a pedestrian on the shoulder of the New Jersey Turnpike, according to the police on the scene. The April 1 report states that the victim of this tragic accident did not survive, passing away shortly after the accident.
According to the news, the accident happened at around 1:14 p.m., and images show that it happened during a sunny day. Visibility should have been high, but it's not clear why the tractor-trailer driver didn't see the person he struck, since they were allegedly standing on the side of the road on the shoulder of the highway. Report claim that the driver did see the vehicle pulled over to the side of the road next to where the pedestrian was hit.
The victim was pronounced dead at 1:55 p.m., according to the news. At the time of the report, the next of kin hadn't been contacted, so no information about the pedestrian was given to the news. State police will now have to investigate the incident to determine what happened and if the truck driver will be charged for the pedestrian's death. If neglect, distractions or speeding is a factor, the driver may face criminal charges for the person's death.
Criminal charges, though, are not required for the family of someone killed by a negligent driver to seek compensation for their loss. Claims may include those for wrongful death, final expenses and other damages.
